What is the option period in Texas?
A negotiated number of days, bought with a negotiated option fee, during which you may terminate the contract for any reason and receive your earnest money back. It is an unrestricted right to walk.
Is the option fee refundable?
Generally no. It is paid for the right to terminate, and it is separate from earnest money, which is refundable if you terminate within the option period.
Why can't I see what homes sold for in El Paso?
Texas is a non-disclosure state, so sale prices are not public record. Accurate comparables come from the MLS rather than from public data or consumer estimate tools.
Who handles closing in Texas?
A title company, rather than an attorney as in some states. They handle title, escrow and the closing itself.
How does property tax work in El Paso?
There is no state income tax, but property tax rates are high and vary by taxing jurisdiction, so two nearby homes can carry very different bills. If the home will be your primary residence, file for the homestead exemption.
Selling your home in El Paso
How do you price a home in a non-disclosure state?
From MLS comparable sales, which are the only reliable record of what properties actually sold for. Public records do not contain sale prices in Texas.
What is the Seller's Disclosure Notice?
A form Texas requires on most residential resales, in which the seller discloses known conditions and defects. Completing it carefully and early prevents most option-period surprises.
Can a buyer really walk away for any reason?
During the option period, yes — that is what the option fee buys. This is why disclosure and preparation before listing matter so much here.
Should I take the highest offer?
Not automatically. Option period length, financing strength and closing timeline change what an offer is really worth, and the highest number is often not the most certain one.
What are your fees?
Negotiable, and agreed in writing before your property is marketed. Nothing is charged that was not set out in the listing agreement first.
Do I need a new survey to sell in Texas?
Not always. An existing survey can often be reused if you provide a T-47 residual affidavit confirming nothing has changed, though the buyer's lender or title company may still require a new one. It is worth locating your existing survey before listing.
Renting in El Paso
When must a Texas landlord return a security deposit?
Generally within 30 days of the tenant surrendering the property and giving a forwarding address, either refunding it or providing a written itemisation of deductions.
How much can a late fee be in Texas?
It must be reasonable. Texas provides a safe-harbour percentage of monthly rent that differs for properties with four or fewer units versus larger properties.
What do I need ready to apply for a rental in El Paso?
Photo identification, proof of income, rental references and any pet records. Having them ready before touring is the biggest practical advantage, especially around PCS cycles.
How does Fort Bliss affect the rental market?
PCS cycles move tenants on military timelines, so availability and competition follow those rhythms rather than a standard calendar year.
Do renters pay a fee?
It varies by property and is disclosed in writing before you apply. Many El Paso rentals are owner-paid, but you will know which applies before you commit.
What security devices must a Texas rental have?
Texas requires landlords to provide certain security devices — including keyed deadbolts and window latches — along with working smoke alarms, generally at the landlord's expense. These are statutory obligations rather than lease negotiations.

Does Texas have rent control?
Texas broadly prohibits local rent control, so rents are set by the market rather than capped by ordinance. That cuts both ways: there is no ceiling on repricing at renewal, and no floor under demand if the local market softens.
The shape of the El Paso market
El Paso is laid out by the Franklin Mountains, which split the city and make "twenty minutes away" mean something different depending on which side of the range you start from. The West Side sits against the mountains, the East Side spreads across the flats toward the horizon, the Northeast runs up against Fort Bliss, and Central and Downtown hold the oldest housing stock in the city. East of the line, Mission Valley and Socorro and Horizon City are where most of the new construction has gone.
Two things make this market unlike anywhere else in Texas. Fort Bliss puts a constant cycle of PCS moves through it — families arriving and leaving on orders, on timelines nobody chose, often buying or renting sight-unseen from another post. And the city is binational: Ciudad Juárez is across the river, and cross-border work, family and commerce are ordinary facts of life here rather than an exception. A bilingual transaction is not a courtesy in El Paso; it is frequently the only way the deal gets done properly.

What is different about transacting in Texas
Texas runs its own forms and its own clock, and neither resembles the North Carolina process.
Contracts are promulgated by the Texas Real Estate Commission, and buyers typically negotiate a termination option — an option fee paid to the seller for a named number of days during which the buyer may walk away for any reason. Closing runs through a title company rather than an attorney's office, which is the single biggest procedural difference for anyone moving here from the East Coast.
The tax side deserves attention before you shop rather than after. Texas has no state income tax and funds local government substantially through property tax, so the rate attached to an address materially changes the monthly payment — two houses at the same price in different taxing jurisdictions do not cost the same to own. Homestead and veteran exemptions matter here in a way they do not everywhere.
